Terms & Conditions

By booking with Sutter Media LLC (“Sutter Media,” “we,” “us,” or “our”), you agree to the following Terms & Conditions. These policies ensure clarity, protect both parties, and allow us to deliver the high-end experience we're known for.

1. Services

Sutter Media provides real estate media, commercial media, social media marketing, branding, advertising services, websites, and other creative solutions. The specific services included in your project will be outlined in your order, proposal, or agreement.

We reserve the right to decline projects that don't align with our brand, standards, or availability.

2. Booking & Scheduling

2.1 Booking

All sessions must be booked through our online system or directly through our team. Dates are first-come, first-served. We do not schedule shoots on Sundays.

2.2 Cancellations / Rescheduling

• Cancellations within 24 hours of the scheduled shoot may incur a fee.
• If weather prevents aerial or exterior work, we will reschedule at no additional charge.
• No-show appointments may be subject to the full session fee.

3. Payment Terms

3.1 Payment

Payment is due at booking or upon completion of the project, depending on service type.

3.2 Late Payments

Overdue invoices may be subject to late fees and halted services until resolved.

3.3 Non-Refundable Fees

Payments for completed work, delivered media, consultations, retainers, or digital products are non-refundable.

4. Deliverables & Turnaround

4.1 Turnaround Times

Standard turnaround times are provided on your booking page or proposal. Rush services may be available upon request for an additional fee.

4.2 Delivery

All final media is delivered digitally through our delivery platform (e.g., Aryeo, cloud link, or equivalent).

4.3 Revisions

• Photo revisions: Limited corrections included where applicable.
• Video revisions: Two rounds included unless otherwise stated.
• Additional revisions are billed hourly or per-revision.

5. Usage Rights & Licensing

5.1 Real Estate Media

Media created for real estate listings is licensed to the client or agent solely for:

• marketing the specific property
• MLS use
• related promotional content for that listing

It may not be reused for future listings or redistributed to third parties (builders, designers, stagers, etc.) without written permission.

5.2 Marketing, Branding, & Commercial Content

For non-real-estate content, a commercial usage license may apply depending on the project.

5.3 Copyright

Sutter Media retains full copyright to all media unless otherwise agreed. Unauthorized editing, resale, or redistribution of our media is strictly prohibited.

6. Client Responsibilities

To ensure smooth production and premium-quality results, clients agree to:

• Have the property or location in shoot-ready condition
• Ensure access to the location at the scheduled time
• Notify us of any restrictions (HOAs, tenants, builders, gated access, etc.)
• Confirm accuracy of all details before final delivery

If a property or project is not prepared, additional fees may apply or the shoot may be rescheduled.

7. Reshoots

Reshoots requested due to:

• changes made after the original shoot
• staging/cleaning not completed prior to the appointment
• inaccurate information provided

may incur additional fees. Reshoots due to photographer error or technical issues are covered by us.

8. Liability

Sutter Media is not responsible for:

• property damage caused by clients, homeowners, tenants, pets, or third parties
• delays caused by weather, construction, travel conditions, or circumstances outside our control
• lost income or opportunity costs due to delayed delivery

No guarantees are made regarding listing performance, social media results, engagement, or sales outcomes.

9. Social Media & Portfolio Use

We reserve the right to use completed media for:

• portfolio display
• social media
• marketing and advertising
• case studies
• educational examples

If you require a non-disclosure agreement (NDA), please request it before the project begins.

10. Copyright Infringement & Misuse

Any unauthorized use, editing, or resale of our media may result in:

• immediate invoice for commercial licensing
• legal action
• removal notices
• additional fees

We take intellectual property protection seriously.

11. Termination

We reserve the right to decline or terminate projects if a client engages in:

• abusive or disrespectful behavior
• misuse of media
• breach of these Terms & Conditions
• requests that violate ethical standards, safety, or MLS rules

12. Changes to Terms

We may update these Terms & Conditions at any time. Updated versions will be posted on our website with a revised “Last Updated” date.
